Terms of Service

1. Agreement

By creating an account or using Sudamate (the “Service”), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.

2. Who can use Sudamate

You must be at least 13 years old. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Accounts

You sign in with Apple or Google. You are responsible for the activity on your account. Notify us at admin@sudamate.com if you suspect unauthorized access.

4. Plans, fees, and billing

Sudamate offers a free tier with weekly usage limits and paid Plus plans (monthly, yearly, and a limited lifetime option). Paid plans are billed through the platform you purchase from — the Apple App Store on iOS, or our web checkout provider (RevenueCat, with Stripe) on the web — and are subject to that platform’s terms. We will tell you clearly before any charge is made. Paid subscriptions renew automatically until cancelled, and you can manage or cancel them in your platform account settings. Prices may change, with notice as required by law. Refunds, where offered, are handled under the applicable platform’s policy and the law of your jurisdiction.

5. Acceptable use

You agree not to:

• Use the Service to harass, abuse, or harm others.
• Reverse-engineer, scrape, or attempt to extract our models, prompts, or training data.
• Use the Service to generate content that violates third-party rights or applicable law.
• Interfere with the Service’s normal operation or attempt to bypass usage limits.

6. Your content

Audio you record and text you generate while using the Service belong to you. You grant Sudamate, and the service providers acting on our behalf, the limited license needed to host, store, transcribe, score, and play that content back to you so the Service works. We do not use your recordings to train third-party models.

7. AI output

The Service uses AI to converse, transcribe, and score. AI output can be wrong. Treat tutor responses as a learning aid, not as authoritative translation or instruction.

8. Our intellectual property

The Service itself — including our software, design, content, models, prompts, and trademarks such as “Sudamate” — belongs to Dodamverse or its licensors and is protected by intellectual-property laws. These Terms do not grant you any right to our branding or to copy, modify, or create derivative works from the Service, except as the law allows.

9. Service availability

We do our best to keep Sudamate running, but we do not guarantee uninterrupted availability. We may add, change, or remove features at any time. Free-tier weekly session limits may change.

10. Termination

You can delete your account at any time from the Settings tab. We may suspend or terminate accounts that violate these Terms. When your account is deleted, we remove your data per the Privacy Policy.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUDAMATE AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Dodamverse and its operators from claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Service or your breach of these Terms or applicable law.

14. Governing law and disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-laws rules. You and Dodamverse agree to submit to the exclusive jurisdiction of the courts of Hong Kong for any dispute arising out of or relating to these Terms or the Service. Nothing here removes any mandatory consumer-protection rights you have under the law of the place where you live.

15. App Store additional terms

You acknowledge that these Terms are between you and Dodamverse, not Apple, and that Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation. You and Dodamverse, not Apple, are responsible for addressing any claims relating to the Service, including product liability, legal or regulatory non-conformity, and intellectual property claims. You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. General

If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. Our failure to enforce a provision is not a waiver. We are not liable for delays or failures caused by events beyond our reasonable control.

17. Changes

We may update these Terms. When we do, we will revise the effective date above. Continued use of the Service after a change means you accept the updated Terms.
